Terms of Use

These terms govern your use of the Party Up app and website. They explain the license, safe play expectations, planned Pro features and the limits that apply to the service.

1. Agreement and eligibility

These Terms of Use (“Terms”) are an agreement between you and the developer of Party Up (“Party Up,” “we,” “us,” or “our”). By downloading, accessing or using the Party Up mobile application (the “App”) or this website (the “Website”), you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the App or Website. If you are not old enough to enter into this agreement where you live, a parent or legal guardian must review and accept these Terms for you.

2. License to use Party Up

Subject to these Terms and the applicable app marketplace rules, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to use the App for private, non-commercial entertainment on devices you own or control.

You may not copy, sell, rent, sublicense, distribute, publicly host, modify, reverse engineer, decompile or attempt to extract the source code of the App except where applicable law expressly permits it. You may not remove ownership notices or use Party Up assets to create a confusingly similar product.

3. Party games and safe play

Party Up provides prompts, randomizers, local multiplayer tools and entertainment games. Players are responsible for choosing age-appropriate packs, setting boundaries and deciding whether to perform any prompt or challenge.

  • Never perform a dare or action that feels unsafe, illegal, humiliating or inappropriate.
  • Respect every player’s right to skip a prompt or leave a round.
  • Keep a secure grip on the device when using shake or motion controls.
  • Do not use the App while driving, cycling or in any situation that requires your full attention.
  • Random results are for entertainment and must not be used for gambling, medical, legal, financial or other high-impact decisions.

4. Acceptable use

You agree not to misuse the App or Website, interfere with their operation, attempt unauthorized access, introduce malicious code, automate abusive requests, infringe another person’s rights, or use Party Up for unlawful purposes.

Player names entered in the App remain on the device. You are responsible for entering them with the players’ knowledge and for avoiding offensive, unlawful or rights-infringing content.

5. Party Up Pro preview

The current build may display concept pricing, planned benefits or an “Unlock Pro” interface. These are previews only. No Party Up Pro purchase, subscription or entitlement is available in the current build, and selecting a preview plan does not create a payment obligation.

Features, artwork, packs, timing and prices shown in a preview may change before release. If paid features are introduced, we will disclose the actual price, billing period, renewal terms, cancellation method and other required purchase information before you confirm a transaction. Marketplace billing terms will also apply.

6. Ownership and feedback

The App, Website, game presentation, illustrations, graphics, text, software, branding and other Party Up materials are owned by or licensed to us and are protected by intellectual property laws. These Terms give you permission to use the product; they do not transfer ownership.

If you voluntarily send suggestions or feedback, you allow us to use them without restriction or compensation, provided we do not identify you publicly without permission.

7. Third-party platforms and services

The App may rely on Apple platform services for distribution, device features, reviews and system interfaces. Contact links open your email provider. Those services are controlled by their providers and have separate terms and privacy policies.

We are not responsible for third-party services, their availability or their content. You must follow the terms that apply to your device, App Store account, internet connection and email service.

8. Updates, availability and support

We may add, change or remove features, content or compatibility requirements. We may suspend the App or Website where reasonably necessary for maintenance, security, legal compliance or product changes. We do not promise that every feature will remain available forever or that the App will work on every device or operating-system version.

Support is available at layseallone@hotmail.com. Apple has no obligation to provide maintenance or support for Party Up.

9. Disclaimers

To the maximum extent permitted by law, the App and Website are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement where those warranties may lawfully be disclaimed.

We do not warrant that Party Up will be uninterrupted, error-free or suitable for every group. Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot legally be excluded.

10. Limitation of liability

To the maximum extent permitted by law, Party Up and its developer will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, personal disputes or injuries arising from optional game prompts or misuse of the App.

Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that law does not allow us to limit.

11. Termination

You may end these Terms at any time by stopping use and deleting the App. Your license ends automatically if you materially breach these Terms. Provisions that by their nature should survive—including ownership, disclaimers and limitations of liability—will continue after termination.

12. Governing rules and disputes

These Terms are governed by the laws applicable where the Party Up developer is established, without regard to conflict-of-law principles. Mandatory consumer protections and your right to bring a claim in a forum available under applicable law remain unaffected.

Before starting formal proceedings, please contact us and give us a reasonable opportunity to resolve the issue informally.

13. Apple App Store terms

When you obtain Party Up through Apple’s App Store, your license to the App is also subject to Apple’s applicable Usage Rules. Unless a custom end-user license agreement is presented in the App Store, Apple’s Standard Licensed Application End User License Agreement applies to the App license.

These Terms are between you and Party Up, not Apple. Party Up is responsible for the App, support, warranties and claims relating to the App to the extent required by law. Apple and its subsidiaries are intended third-party beneficiaries of the App license terms and may enforce those terms.

You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on a United States government prohibited or restricted-party list.

14. Changes to these Terms

We may update these Terms to reflect product or legal changes. We will post the new version here and change the effective date. If a change materially affects your rights, we will provide additional notice where appropriate. Continuing to use Party Up after the revised Terms take effect means you accept them.
